Punjab Police saves influential culprits by flouting orders of High Court and Supreme Court for the last 4 years.

Gagandeep, a promising MBA student of Thapar University Patiala, son of Sh. Gurbax Singh Bains, resident of Mohali,after retiring as Class-I Officer of Indian Audit Department,and practicing  Advocate  in the Punjab and Haryana High Court for the past 10 years,was murdered on 28.9.2010 by his classmates Zorawar Singh and his accomplices. The father of ZorawarsinghieGurmeet Singh,  who was at the moment posted as SDM of Patiala, by misuse of his position being in close coordination with police,  had arranged a FIR No 219 dt 28.9.2010at PS City Rajpura u/s 304A, through his relative, Jarnail Singh of Patiala, showing murders as accident.After getting clues of murder and collecting circumstantial evidence, the aggrieved father, laid his hands on the face book writings of Zorawar Singh made from August 20, 2010 to Nov 2010, with his accomplices that he wanted to kill two-three of his male class mates and after murders wrote that he has achieved his target. So the father,wrote a complaint to the Hon’ble Punjab and Haryana High Court and Punjab Govt attaching the evidences he had gathered. As a follow up action, the Inquiry Officer nominated by the Govt., Sh. Kanwar Vijay Partap Singh made a thorough inquiry pinpointing it being a murder case.Sh. Kanwar Vijay Partap Singh prepared his detailed report after one years efforts and opined  that as the matter is serious, it is imperative that  a case  under section 302 IPC may be registered against Zorawar Singh and Jaskaran Singh (so called survivors of accident)and their custodial interrogation may be done by some independent agency to find out truth. The Police Department instead of presenting this report in the Hon’ble High Court and, without obtaining the orders of the Govt.,with the intention to hush up this murder case further marked the enquiry to some otherofficer Sh. B.K. GargIG , who  submitted his report within 10 days, by nullifying the very exhaustive repost of Sh Vijay Partap Singh , prepared in one year.
    On presenting of both reports before the Hon’ble High Court rejected the report of sh. B.K. Garg and  give directions for implementing the report of Sh.Kanwar Vijay Partap Singh  in letter and spirit.  Police did not act on these orders and paved the way for the accused who took stay from the Supreme Court.  Finally on 4.12.2014 Hon’ble Supreme Court ordered that report of Sh.Kanwar Vijay Partap Singh may be followed and implemented in which he had recommended registration of murder case against the accused persons and conduct custodial interrogation by some independent agency.Thereafter, although the police registered FIR No 288 dt 44.12 2014 u/s 302 at PS City Rajpurabut got investigation conducted through Sh.Jaskaran Singh SP Patiala  who presented a challan of accident in the Rajpura Court in August 2015.The aggrieved father filed a contempt petition in the Hon’ble High Court who rejected this report too and reiterated that ShKanwar Vijay Partap Singh’s report may be implemented .During hearing of this contemt proceedings, the accused moved an application in the High Court against this contempt petition,  which was dismissed by the Hob’ble High Court.  Then, the police handed over the investigation to Smt. Sanmeett Kaur AIG  who, in May 2016  again submitted a report in the Rajpura Court wherein she recommended the conversion of  charge under  sec 302IPC to that of an accident case. However, on placing this report before the Hon’ble Supreme court, the Hon’ble supreme Court after hearing the  averments of aggrieved father  rejected this report and  give full authority to Judicial Magistrate, Rajpura Court  to hear the protest petition of aggrieved father and deliver justice to him.The Hon’ble Rajpura Court during hearing on the protest petition of aggrieved father,  after hearing the arguments of Govt. Counsel and Petitioner’s Counsel Sh.Jagjot Singh Lali opined that although the police has made deep investigation but  it is surprising to note that the investigating agency has failed  to  comply with the orders of Hon’ble High Court and Hon’ble Supreme Court which is a deplorable fact. Hon’ble Rajpura Court directed that the investigating agency should have done custodial interrogation of the accused persons which could bring more facts of this case and by not doing so, brings a suspicion that truth is being concealedtill now.
It is worth mentioning here that   various social organizations of Mohali  after forming a joint front had made struggle against this political barbarism for  quite long time and protested against this  injustice by making  processions and demonstration in front of DC office Mohali . Despite this the then Badal Govt. did not awaken from deep sleep.  During the present Congress Govt., the aggrieved father  again moved an application to the Hon’ble Chief Minister Sh. Amarinder Singh  and  suspecting inaction in the matter had requested for handing over the investigation of this murder case to CBI which was marked to DSP Mohali who after hearing the  circumstances of the case  sent a report to Higher Authorities.  But the Govt. has not implemented the orders of Supreme  Court till now.
During the press conference Satnam Daun, ADvocate Jaspal Singh Dhapper & Advocate Tejinder sidhu (Members Punjab Against Corruption NGO)further told that apart from Gagandeep son of Sh. Bains, another boy named Gaurav Verma, a resident of Delhi was also murdered but  the parents of that boy could not pursue the case due to high links and influence of accused in this case.   He further said that when an educated person who is a retired Class-1 officer of Govt.of India and is a practicing advocate, has to face such a tragic situation in old age which is the age to lead  retired peaceful life,  what can be the plight of common men who do not dare to go to Courts time and again against such  high handedness of police .Satnam DAun : 85281-25021, Advocate Gurbakash Singh Bains, : 94171-39595, 90414-51995.
