OPEN LETTER TO THE HON'BLE CJI
RESPECTED CHIEF JUSTICE OF INDIA

THIS IS WITH REGARD TO THE VIOLATION OF PRINCIPLES OF NATURAL JUSTICE OF STUDENTS OF TERMINAL YEAR AND INFRINGEMENT OF ART 14 AND 21. THE MATTER OVER THE TERMINAL EXAMINATION HAS BEEN MUCH POLITICISED AND GUIDELINES ISSUED BY THE UGC, WHICH ARE CHANGED EVERY FEW DAYS, HAVE CREATED A CHAOTIC SITUATION. THE EARLIER GUIDELINES ISSUED BY UGC, LEFT THE FINAL CALL FOR THE EXAMINATION TO THE UNIVERSITIES AND STATED THAT THE SITUATION OF PANDEMIC WOULD BE TAKEN INTO ACCOUNT. AS THE NUMBER OF CASES SOARED, FOLLOWING POLITICAL BATTLES, THE EXAMINATION HAVE BEEN MADE MANDATORY. THAT THE MITs REPORT PREDICTS A SHARP INCREASE IN THE GRAPH, WITH SITUATION GETTING WORST UPTO FEBRUARY 2021, WITH 2.87 LAKH CASES PER DAY. THAT THE PRACTICAL EXAMINATION OF MOST UNIVERSITIES COULD NOT BE CONDUCTED AND MANDATING TERMINAL EXAMINATION, IN A SITUATION, WHERE MOST UNIVERSITIES, AND STUDENTS ARE UNPREPARED WOULD ONLY LEAD TO MORE CHAOS. THAT THE STAKEHOLDERS, INCLUDING THE PARENTS, STUDENTS AND EVEN MOST UNIVERSITIES ARE OPPOSING THE SUDDEN EXAMINATION. THAT OUT OF BAFFLEMENT MANY INSTITUTES STARTED CONDUCTING EXAMINATION IN JULY, IN CONTRAVENTION OF NATIONAL DISASTER MANAGEMENT GUIDELINES. THAT THE INTER-STATE TRAVEL RULES DIFFER, AND WITH STATES ON THE VERGE OF GOING BACK INTO LOCKDOWN, THE PRACTICAL POSSIBILITY OF HOLDING EXAMINATION, SEEMS LITTLE. THAT THE DECISION GIVEN ONCE, CHANGED EVERY FEW DAYS, HAS SERIOUS CONSEQUENCES ON THE MENTAL CONDITION OF YOUTH, ALREADY FACING FRUSTRATION DUE TO UNEMPLOYMENT AND LOCKDOWN. THAT THE EXAMS, SCHEDULED TO BE CONDUCTED IN MAY/JUNE/JULY, WHEN SCHEDULED FOR SEPTEMBER, WOULD LEAD TO AGE BAR ISSUES OF YOUTH SEARCHING FOR GOVERNMENTAL JOBS. THAT AS THE HON’BLE PRIME MINISTER, HIMSELF STATED, IN HIS LIVE ADDRESS ON 15.07.2020, THAT LEARNING OF “SKILLS”, IS WHAT MATTERS THE MOST FO THE YOUTH, ROTE EXAMINATION, WOULD HARDLY JUSTIFY THEIR SKILL UPGRADATION, BUT DEFINITELY ENDANGER THEIR LIVES IN TIMES OF THESE pandemics. THAT THE HON’BLE JUDICIARY MAY KINDLY TAKE COGNIZANCE OF THE MATTER, AND MULTIPLE OPEN LETTERS WRITTEN IN THIS REGARD, BY STUDENTS THROUGHOUT THE COUNTRY. IN THESE TRYING TIMES, WE LOOK UPTO OUR HON’BLE JUDICIARY, WHEREVER THE EXCESS OCCURS, SO THAT SYSTEM OF CHECKS AND BALANCES, AS ENSIGASED BY THE CONSTITUTION MAKERS, BETWEEN THE LEGISLATURE, EXECUTIVE AND JUDICIARY REMAINS HONOURED. THAT AS THE LIVES AND CAREERS OF STUDENTS IS IN LIMBO, WE LOOK UPTO OUR HONORABLE JUDICIARY TO RISE UPTO THE OCCASION.
